1. SCOPE.

These subscription terms apply to customers with the FREE, PRO, PRO+ (legacy) and PREMIUM subscriptions.

2.1. About Mileage Book

Mileage Book is a system for collecting mileage data and handling and managing mileage accounts. The system consists of an app and a website, and data is stored on a cloud-based server solution.

2.2 Language

When entering into agreements with Mileage Book, the customer accepts that all information from Mileage Book in connection with the agreement is communicated in Danish or English.

2.3 The use of Mileage Book

is based on information from the built-in GPS in the customer's smartphone and/or borrowed tracker. The Mileage Book app is available for iOS (iPhone) and Android. The app is available for free download via App Store and Google Play.

2.4 Mileage Book website

is at least compatible with the browsers Google Chrome, Safari, Internet Explorer and Firefox. In order to access the site, you must create a subscription via www.mileagebook.com.

2.5 The Mileage Book app collects driving data

and calculates the customer's approximate location using information from mobile, WiFi and GPS networks. Please note that GPS accuracy varies depending on the number of visible GPS satellites. In some cases, it may take several minutes to search for all visible satellites and the accuracy will gradually increase during the search.

2.6 Recorded driving data

is transferred via WiFi or GPS network to Mileage Book's servers where the mileage data is stored. The Mileage Book site is hosted on Microsoft Azure which has data centers all over the world.

2.7 You access your mileage data

via www.mileagebook.com and depending on subscription, the site provides access to a wide range of features including viewing mileage on a map, editing mileage, creating new trips, managing mileage reimbursement or tax deductions and exporting data as CSV, Excel, and PDF files.

2.8 Right of use

The customer can obtain right of use with one of defined subscription types. The complete list of subscription types, including features, can be accessed directly via the Mileage Book website.

 

3. SUBSCRIPTIONS AND PAYMENT

3.1 Prices

- All prices represented in Mileage Book are by default excl. 25% VAT. Prices for subscriptions purchased via the App Store can be found in the Mileage Book app.

- Unless expressly agreed between the parties, the subscription price is in accordance with Mileage Book ApS' price list applicable from time to time and Mileage Book has the right

(1.) to increase the subscription price annually with 30 days prior notice, and

(2.) at any time if it is subject to changes in government fees, taxes or charges.

If the customer notifies Mileage Book in writing of its rejection of the adjustment within 14 days of providing such information, the customer may terminate the relevant agreement with Mileage Book with effect from the date one month after Mileage Book has received notice of the customer's rejection.

3.2 Channel and method

- Payment can only be made by linking a valid payment card.

- Payment is made via Nets Easy when the customer has accepted Mileage Book's terms and conditions. A payment window will open when the terms are accepted.

- The payment will be charged to the specified payment card and the subscription can then be used.

3.3 Encryption

- All payments are made over secure, encrypted connections.

3.4 Frequency

For subscriptions with monthly payments, the payment for the coming month is deducted on the same day of the month as the first payment was made. If the first payment was made on January 10, the next payment will be deducted on February 10 and so on. If the first payment was made on the 29th, 30th or 31st of a month, subsequent payments will be deducted on the day of the month or on the last day of the month. For subscriptions with prepayment for 1 year, the next payment will be deducted on the anniversary of the first payment. If the first payment was made on January 10, 2020, the next payment will be deducted on January 10, 2021. If the first payment was made on February 29, subsequent payments will be deducted on February 28. A receipt for the purchase will be sent by email to the user's designated email address immediately after the transaction has been completed.

3.5 App Store payment

If payment is made via the App Store, the App Store payment terms apply. The subscription will be renewed automatically unless canceled at least 24 hours before the end of a subscription period. You have the option to turn off automatic renewal in the settings of the relevant iTunes account after the purchase has been completed.

3.6 Replacement of payment card

When replacing an enrolled payment card, this must be changed directly via the user's own account, which is accessed via the Mileage Books website.

 

4. RIGHT OF WITHDRAWAL

- The customer has the right of withdrawal, i.e. the right to withdraw from the agreement without giving reasons, provided this is done within 14 days of the conclusion of the agreement.

-If the customer wishes to make use of the right of withdrawal, this must be done to Mileage Book support by email support@mileagebook.com or telephone +45 70 25 11 01.

-If the customer has paid via the Apple App Store, the subscription must be canceled from the App Store: Instructions for canceling an Apple subscription.

 

5. SERVICE

6. DURATION AND TERMINATION

6.1 Term

All subscriptions with payment directly at Mileage Book can be terminated with immediate effect via login from the website and expire before the next payment period begins. Full access to the account in question is offered until the day the subscription expires. If the subscription is paid via the Apple App Store, the subscription must be canceled from the App Store: Instructions for canceling an Apple subscription.

6.2 Refund

Already paid subscriptions are non-refundable. Payments made through the App Store and Google Play are handled by these.

6.3 Notification

A subscription must be canceled by logging into your own account at https://app.mileagebook.dk/account/login and canceling the subscription or by sending an email to support@mileagebook.com.

6.4 Data deletion

Three months after termination of the subscription, the customer's data including personal information and credit card information will be deleted.

 

7. HARDWARE AND EQUIPMENT

7.1 Delivery of devices

- When purchasing the PRO+ (legacy) and PREMIUM subscriptions, borrowed hardware in the form of a GPS tracker is included.

- Mileage Book ships devices to business addresses or parcel shops.

7.2 Return of devices

- For selected subscriptions, Mileage Book lends hardware and equipment to the customer for use for the duration of the subscription.

- Upon termination of the subscription, hardware and equipment must be returned to Mileage Book no later than 14 days after the subscription has expired.

- The customer is responsible for any return costs.

- If the deadline for return is exceeded, we will send an invoice for the purchase of borrowed equipment.

- Sender name, company name or address must be included to properly unsubscribe devices.

7.3 Price for devices

- Price for iBeacon: 360 DKK excl. VAT (450 DKK incl. VAT)

- Price for GPS tracker: DKK 749 excl. VAT (DKK 936.25 incl. VAT)

8. OTHER TERMS AND CONDITIONS

The subscription and the resulting time-limited right of use is personal and may not be transferred or otherwise made available to third parties. The Customer is responsible for compliance with the terms and conditions.

 

9. LIABILITY

- Mileage Book provides no warranty. Mileage Book limits its liability so that Mileage Book's liability can never exceed the amount paid by the customer for the subscription in question.

- If the subscription has had a duration of more than 1 year, Mileage Book's liability is limited to an amount corresponding to the previous year's subscription payment.

- Mileage Book is also not liable for any indirect or consequential loss or damage, including but not limited to operating loss, loss of time, loss of data, loss due to third party services such as erroneous GPS data, loss of profit and lost tax deductions. Tax deductions for driving are often based on shortest distance, which does not always correspond to the route chosen by the customer.

- Use of hardware and equipment is at the customer's own risk. Mileage Book is not responsible for use that results in damage to phone, car or other equipment.

 

10 CHANGES

- Mileage Book reserves the right to change these terms and conditions at any time.

- Mileage Book also undertakes to keep the customer informed if the customer's terms and conditions change in the future.

 

11. PERSONAL DATA POLICY

Mileage Book will need to collect, process and store the customer's GPS data to the extent necessary to offer the Mileage Book facilities. The customer thus accepts that for all devices associated with the selected subscription, the customer and the associated devices' GPS location data will be collected, processed and stored, and that Mileage Book may make this data available to the third parties that Mileage Book uses to operate the Mileage Book. By using the Mileage Book, the customer and the connected devices accept that personal information and GPS data may be transferred and processed in a country other than the customer's home country. 12 LEGAL

Danish law, with the exception of the Danish international conflict of laws rules, applies to the settlement of any dispute with Mileage Book.

12.1 Venue

Any disputes between the customer and Mileage Book can only be settled by the Court in Viborg, Klostermarken 10, DK-8800 Viborg, Denmark.
